Terms of Service
The services (hereinafter referred to as "the Service") provided by Time with My Parents (hereinafter referred to as "the App") to customers (hereinafter referred to as "Users") are provided in accordance with these Terms of Service for Time with My Parents (hereinafter referred to as "these Terms"). These Terms set forth the conditions for providing the Service and the rights and obligations between the Time with My Parents Secretariat (hereinafter referred to as "the Secretariat") and Users. Users must agree to these Terms when using the Service. By using the Service, Users are deemed to have agreed to these Terms.
Article 1: Application
1. These Terms are intended to define the conditions for providing the Service and the rights and obligations between the Company and Registered Users regarding the use of the Service, and shall apply to all relationships between Registered Users and the Company regarding the use of the Service.
2. If the content of these Terms differs from the rules mentioned in the preceding paragraph or other descriptions of the Service outside these Terms, the provisions of these Terms shall take precedence.
Article 2: Definitions
The terms used in these Terms are defined as follows:
- Secretariat Website: A website operated by the Secretariat with the domain "oyatonojikan.com"
- Secretariat Application: The smartphone application "Time with My Parents" distributed on the "App Store" operated by Apple Inc. or iTunes K.K. (including any applications after changes to the service name or content, regardless of the reason)
Article 3: Service Overview
1. The functions of the Service (hereinafter referred to as "the Functions") are as follows. The Functions may be determined and changed by the Secretariat without the consent of Users. Please note that even on supported devices, some Functions may not be available depending on the model.
- Function for Users to register themselves, relatives, or related persons as members, register birthdays or ages, and view them in a list
- Function for Users to register schedules on a calendar
- Function for Users to write, edit, and view content on the Service
- Function to receive reminders for schedules
- Function to receive notifications and announcements from the Secretariat
- Other functions separately determined by the Secretariat
2. The Functions and their usage conditions can be freely set by the Secretariat, and may vary daily and differ among Users based on usage patterns obtained through the Service (usage history), day of the week, time of day, weather, and other various conditions.
3. Communication devices, communication means, power, and other items necessary for using the Service must be prepared at the User's expense and responsibility.
4. The Secretariat may place advertisements of the Secretariat or third parties on the Service. Transactions with advertisers who advertise on the Service are conducted at the responsibility of the User and the advertiser, and the Secretariat assumes no responsibility for any damages suffered by Users in connection with such transactions.
Article 4: Suspension of Use and Deletion of Registration
If the Secretariat determines that a User has engaged in conduct that violates these Terms or that the continuation of the service usage contract is inappropriate, the Secretariat may take measures to suspend the User's use or delete the User's registration without prior notice or demand.
Article 5: Termination of Use
Deletion of User registration or uninstallation of the Application shall be deemed as termination of use by the User. However, obligations that the User has assumed to the Secretariat before termination of use shall continue to exist after termination of use.
Article 6: User Responsibilities
1. Users shall use the Service at their own risk and shall bear all responsibility for all actions taken by Users using the Service and the results thereof.
2. If any dispute arises between a User and a third party due to the use of the Service, the User shall resolve the issue at the User's expense and responsibility and shall not cause any inconvenience or damage to the Secretariat. If damage is caused to the Secretariat or a third party through the use of the Service, the User shall compensate for such damage to the Secretariat or the third party.
3. The Secretariat does not guarantee that schedules and other data registered on the Secretariat Application will not be lost. Users need to perform backups themselves. The Secretariat is not obligated to perform backups.
Article 7: Prohibited Acts
The Secretariat prohibits acts that fall under or are judged by the Secretariat to fall under any of the following items. If the Secretariat judges that a User has engaged in such acts, the Secretariat may take measures deemed necessary by the Secretariat, such as suspending use, deleting registration, stopping or modifying calendars, etc., for the User without prior notice to the User. Even if damage or disadvantage occurs to the User due to such measures, the Secretariat assumes no responsibility.
- Acts that violate these Terms
- Acts of fraud or intimidation against the Company, other users of the Service, or other third parties
- Acts that violate public order and morals
- Acts that infringe intellectual property rights, portrait rights, privacy rights, etc.
- Acts that violate laws or are related to criminal acts
- Acts that place an excessive burden on the network or system of the Service
- Acts of unauthorized access to the network or system of the Service
- Acts of transmitting information containing computer viruses or other harmful programs to the network or system of the Service
- Other acts that the Secretariat deems inappropriate
Article 8: Suspension of the Service
The Secretariat may suspend or interrupt the provision of all or part of the Service without prior notice to Users in any of the following cases. The Secretariat assumes no responsibility for any damages suffered by Users due to measures taken by the Secretariat based on this article.
- When performing inspection or maintenance work on the system related to the Service
- When the Service cannot be provided due to force majeure such as power outages or natural disasters
- When the Service cannot be provided due to accidents involving computers, communication lines, etc.
- When the Service cannot be operated due to system failures, hacking, etc.
- When the Secretariat deems it necessary to suspend or interrupt the Service
Article 9: Changes to or Termination of the Service
The Secretariat may change the content of the Service or terminate its provision at its convenience.
Article 10: Disclaimer
1. The Secretariat makes no warranty that the Service will be suitable for the User's specific purposes, will have expected functions, value, accuracy, or usefulness, or will be free from defects.
2. The Secretariat assumes no responsibility for any damages suffered by Users due to the use of the Service. The same applies to damages caused by the inability to use the Application due to defects, errors, failures, etc., that occur in the Secretariat Application, and damages caused by terrorism, criminal acts, illegal acts, etc., against the Secretariat or Users.
3. The Secretariat shall not be involved in Users' communications or activities. Even if there is a dispute between Users, it shall be resolved between the Users concerned, and the Secretariat assumes no responsibility.
4. The Secretariat is not obligated to monitor or save information such as logs posted by Users.
5. All responsibility for managing information stored on Users' devices using the Service lies with the Users, and the Secretariat assumes no responsibility for damages caused by loss, theft, hacking, or other events involving devices.
6. If these Terms constitute a consumer contract as defined in Article 2, Paragraph 3 of the Consumer Contract Act, provisions of these Terms that completely exempt the Secretariat from liability for damages based on breach of contract or tort by the Secretariat shall not apply. In this case, the Secretariat shall be liable for damages only to the extent of direct damages suffered by the User, except in cases where the Secretariat has intentional or gross negligence.
Article 11: Attribution of Rights to the Service
1. Copyrights, trademark rights, and other property rights related to content (excluding posted content), individual information, trademarks, images, advertisements, designs, etc., contained in the Secretariat Website and the Secretariat Application belong to the Secretariat or the author or copyright holder who created the content.
2. The Service and all related software contain property rights protected by laws concerning intellectual property rights. Users shall not reproduce, edit, post, publicly transmit, distribute, sell, provide, translate, or otherwise use or utilize the content of the Service and all related software, except when permitted to use by the Secretariat and third parties holding copyrights or other property rights, or when such use is permitted by law without permission from the rights holder.
3. The Secretariat assumes no responsibility for damages suffered by acts that violate the preceding paragraph. In addition, if Users gain profits through such acts, the Secretariat has the right to claim an amount equivalent to such profits.
Article 12: Handling of User Information
1. The handling of user information by the Secretariat is subject to the separate provisions of the Secretariat's Privacy Policy. Users agree that the Secretariat will handle Users' user information in accordance with this Privacy Policy.
2. The Secretariat may use and disclose information, data, etc., provided by Users to the Secretariat as statistical information in a form that does not identify individuals, at the discretion of the Secretariat.
Article 13: Surveys
1. The Secretariat may conduct surveys, etc., for Users from time to time to improve the Service.
2. Intellectual property rights, including copyrights, and all other rights related to the content of Users' responses to surveys, etc., shall be transferred to the Secretariat at the time Users submit responses to the Secretariat, and the purpose of use shall be in accordance with the handling defined in the Secretariat's Privacy Policy.
3. Users warrant to the Secretariat that data provided to the Secretariat or advertisers for the purpose of responding to surveys, etc., does not infringe any third party's copyrights, portrait rights, or any other rights, and is lawful.
9. If any claims of rights, objections, complaints, claims for damages, etc., are made by a third party regarding the data provided, or if damage occurs to the Secretariat, the User who caused the dispute or damage shall bear the costs required for processing by the Secretariat and shall compensate for damages.
Article 14: Amendments to the Terms
The Secretariat may change these Terms, and when these Terms are changed, the content of the revised Terms will be posted on the Secretariat Website or Secretariat Application for Users. Changes to these Terms shall become effective when the revised Terms are posted. If a User uses the Service after such posting, the User is deemed to have agreed to the changes to these Terms.
Article 15: Contact and Notices
Inquiries regarding the Service, notifications regarding changes to these Terms, and other communications or notices from the Secretariat to Users shall be made by the method determined by the Secretariat.
Article 16: Assignment of Status under the Usage Contract
1. Users may not assign, transfer, or otherwise dispose of their status under the usage contract or rights or obligations under these Terms to third parties without the prior written consent of the Secretariat.
2. If the Secretariat transfers the business related to the Service to another company (including but not limited to business transfers, acquisitions, mergers, company splits, etc.), the Secretariat may transfer its status under the usage contract, rights and obligations under these Terms, and Users' registration information and other customer information to the transferee of the business transfer in connection with such business transfer, and Users are deemed to have agreed in advance to such transfer in this paragraph.
Article 17: Severability
Even if any provision of these Terms or any part thereof is determined to be invalid or unenforceable under the Consumer Contract Act or other laws, the remaining provisions and parts of these Terms shall continue to be fully effective.
Article 18: Governing Law and Jurisdiction
These Terms and the service usage contract shall be governed by Japanese law. All disputes related to these Terms or the service usage contract shall be subject to the Tokyo District Court.
